WHY DO I HAVE TO REGISTER AND NOTIFY MY WEBSITE TO THE MINISTRY OF INDUSTRY AND TRADE?

Comply with the law as prescribed by the Ministry of Industry and Trade

According to Decree No. 52/2013/ND-CP issued on May 16, 2013, Circular No. 47/2014/TT-BCT issued on December 5, 2014, and Decree No. 185/2013/ND-CP regulating administrative sanctions for violations in commercial activities issued on November 15, 2013, all websites operating in the field of e-commerce must notify or register with the Ministry of Industry and Trade.

According to the Ministry of Industry and Trade, cases of failure to register/notify websites providing e-commerce services will be handled according to the law under Decree 98/2020/ND-CP:

  • A fine of VND 20,000,000 to VND 30,000,000 for one of the following acts: failure to register websites providing e-commerce services with competent State management agencies as prescribed;
  • Traders/organizations that repeatedly violate or re-offend will be subject to a penalty of suspension of e-commerce activities from 06 to 12 months.

When the declaration is successful, the e-commerce website will be provided with a Logo that has the words “Notified”.

Only e-commerce websites that have registered with the Ministry of Industry and Trade will have a link to the website information on the Ministry of Industry and Trade’s management page.

When an e-commerce website completes the registration procedure, it means that this website is legally established and it now can operate in Vietnam under the guarantee of the State.
